Man arrested on sex assault charges

Authorities have arrested a locally employed man on charges of sexual assault, with another charge of attempted sexual assault possible.

Abraham Cortez-Jimenez, 25, was arrested Wednesday for an alleged incident that took place late Tuesday night or early Wednesday morning. Pitkin County Sheriff’s Office investigators are not revealing details of the case, as it is still under investigation, but one of two alleged victims reported the incident, investigator Ron Ryan said.

Cortez-Jimenez is contesting the charges, said attorney Jeff Wertz, who is representing Cortez-Jimenez.

“(My client) is presumed innocent under the law until proven guilty,” Wertz said.

At an arraignment on Thursday, Judge James Boyd raised Cortez-Jimenez’s bond from $5,000 to $15,000.

Deputy District Attorney Arnold Mordkin said Cortez-Jimenez may also have a warrant out for his arrest on felony burglary charges from San Bernardino, Calif., but that the jail was still confirming that the California warrant is for the same person.

Cortez-Jimenez has also been placed under hold by the federal Immigration and Customs Enforcement agency, meaning immigration authorities believe he may be in this country illegally.

The alleged incident took place at a residence east of Aspen near mile marker 44 on Highway 82, Ryan said. The accuser had recently met Cortez-Jimenez, Ryan said.

It’s not clear how the second alleged victim comes into play, but prosecutors said that Cortez-Jimenez could face an additional charge of attempted sexual assault.

“We anticipate a second charge,” Mordkin said. “I can’t say what charge, but there is a second person involved.”

Judge Boyd gave Mordkin until Jan. 12 to file charges in the case, the same day as Cortez-Jimenez’s next scheduled court appearance.
